Ironically today, 183 years later and without scientific justification, many national dental associations have amended their Codes of Ethics making the removal of serviceable mercury fillings an issue of unethical conduct when the reason for removal is to eliminate a toxic material from the human body; and if this recommendation is made solely by the dentist. In their view, a dentist is "ethical" if he places the mercury material and recommends its safety. But, if the dentist suggests that the mercury fillings are potentially harmful or that exposure to unnecessary mercury can result, then the dentist is acting "unethically". Dentists can remove mercury fillings upon a patient's request or under the prescription of a physician. This relegates the dentist into the role of a mere technician - a tooth carpenter.

Washington State Dental Association. News & Information. WSDA's 2002 Legislative Agenda Regulation of Dental Amalgam As a Source of Mercury Waste.
WSDA's position: WSDA supports scientifically valid policies to reduce dental amalgam discharges. WSDA encourages dental offices to install amalgam separators and follow best management practices for disposal and recycling of amalgam through a voluntary compliance program. Background: WSDA has worked to revise the state's draft Mercury Chemical Action Plan to include a voluntary compliance program in a partnership between government and dentistry to reduce amalgam waste. WSDA does not support a regulatory requirement for separators, as their effectiveness will vary depending on office practices and configuration of wastewater systems. Dentistry accounts for only a tiny fraction (0.4 percent, according to the EPA) of total discharged mercury waste. WSDA urges the state to examine what actions it can take to reduce mercury pollution from major sources, such as domestic and foreign utility plants, which account for more than 75 percent of mercury discharges.

California Judge Approves Landmark Warning on Mercury Use in Dentistry. (San Francisco, CA) - For the first time anywhere, dentists will be required to post a warning about the dangers of mercury in their dental fillings. A California Superior court judge finalized the language for the warning to be posted in dentists' offices here today. The warning will read as follows: Notice to Patients, Proposition 65: Warning on dental amalgams, used in many dental fillings, causes exposure to mercury, a chemical known to the state of California to cause birth defects or other reproductive harm. Root canal treatments and restorations including fillings, crowns and bridges, use chemicals known to the state of California to cause cancer. The U.S. Food and Drug Administration has studied the situation and approved for use all dental restorative materials. Consult your dentist to determine which materials are appropriate for your treatment. The exact language of the warning was argued and then finalized before Superior Court Judge James A. Robertson II between the California Dental Association, the largest constituent organization of the American Dental Association and Attorney Shawn Khorrami (Cor-ahm-mee). The agreement requires its member dentists to warn patients about the toxic dangers of mercury dental fillings and root canals. The agreement also allows non-CDA dentists to opt in to the agreement and post the warning. The warning is the result of a lawsuit filed by The Law Offices of Shawn Khorrami on behalf of As You Sow, a not-for-profit foundation dedicated to advocacy and activism in the public interest. This is the first admission by organized dentistry that amalgams pose a potential health risk," says Shawn Khorrami, lead attorney. "The only problem is that it's about 100 years too late" This California consent judgment follows on the heels of recent lawsuits filed in Georgia, Texas, Ohio and Los Angeles, California charging that mercury fillings placed in a woman's mouth contributed to the autism of her child, as well as lawsuits in Maryland, California, and New York charging the American Dental Association with misrepresenting amalgam dental fillings as "silver"; The lawsuits basically allege that such fillings actually contain approximately 50% mercury by weight. They cause continuous, daily exposure to mercury and, thereby pose substantial health risks to certain users. Mercury, a highly toxic substance, is the most widely used substance in dental fillings today.

"Sometime this month, the government of Norway will release for public comment the recommendation that dentists no longer use dental amalgam. That's the word from Liljan Aandahl, senior advisor to the Norwegian Directorate for Health and Social Welfare. The public will have three months to respond to the proposal, which could be enacted Jan. 1, 2003.
The Norway recommendation is among the most recent actions on amalgam by any government. In 1997, the World Health Organization hosted a conference titled "Dental Amalgam and its Alternatives," which included government officials, academics and representatives of professional organizations from New Zealand, France, Germany, Sweden, Austria, Finland, England and the United States.
The participants unanimously endorsed a consensus statement that reads, in part, "Dental amalgam restorations are considered safe, but components of amalgam and other dental restorative materials may, in rare instances, cause local side-effects or allergic reactions. The small amount of mercury released from amalgam restorations, especially during placement and removal, has not been shown to cause any other adverse health effects."

Upon completion you have a very good idea of what to do if you think you may be toxic and more importantly, how to go about correcting the problem.
